A short guide to the AI Act
The EU Artificial Intelligence Act (Regulation (EU) 2024/1689) uses a risk-based framework. For HR, Annex III point 4 is especially relevant: it covers certain systems for recruitment and selection, decisions affecting work relationships, task allocation, and monitoring or evaluation. Classification depends on the system’s intended purpose and real use, not the fact that it uses AI alone.
Article 6(3) provides a limited route for some Annex III systems to be treated as non-high-risk when they perform a narrow procedural, preparatory, or human-support task without materially influencing a decision. That route is unavailable where the system performs profiling of natural persons.
